Option Periods

The label's right to extend the deal for additional albums, which only they can choose to exercise.

In plain English
Option periods give the label, not the artist, the right to extend the contract for additional albums or years. After the initial period, the label decides whether to pick up the option. The artist has no equivalent right to leave, creating a one-sided relationship.
Why it matters
A '1 + 4 options' deal means the label can hold you for up to five albums on terms set at signing. If your first album blows up, the label benefits from options negotiated before you had leverage. Artists cannot renegotiate mid-deal as careers grow.
Where it can land
The same clause is drafted three ways. These are the positions we see, worst first, so you can tell at a glance which one is in front of you.
- 4 or more option periods with no renegotiation trigger on commercial success
- Options auto-exercise unless label gives notice, silence means lock-in
- Option royalty rates identical to initial period rates regardless of performance
- 3 option periods (common but worth negotiating down)
- No escalating royalty rates or advance floors across options
- Escalating royalty rates or minimum advances guaranteed at each option
- Artist right to renegotiate if recordings achieve commercial thresholds (e.g. 500k units)
- Option window limited (e.g. label must exercise within 60 days of previous period ending)
