In plain English

An inactivity reversion gives you the right to reclaim recordings that have been released but are no longer being actively exploited. If the label stops making a recording commercially available for a defined period (typically 12–18 months), you can trigger reversion. This prevents the label from holding released catalogue indefinitely without generating any income for the artist.

Why it matters

Labels accumulate large catalogues and cannot actively promote every artist. Inactivity reversion ensures your recordings don't sit dormant with a label that has moved on, you can reclaim them and continue to exploit them yourself.

Where it can land

The same clause is drafted three ways. These are the positions we see, worst first, so you can tell at a glance which one is in front of you.

Off marketPush back
  • Inactivity clause requires complete commercial unavailability in all territories worldwide
  • Label can satisfy 'exploitation' by a single digital listing with no active promotion
  • Inactivity period exceeds 24 months
StandardWorth negotiating
  • Exploitation defined as 'available on at least one DSP' without any active marketing requirement
  • Inactivity period of 18–24 months before trigger
Artist-friendlyWhat fair looks like
  • Inactivity defined as: not commercially available in at least 3 major markets for 12 months
  • Reversion automatic on trigger, no cure period required
